{"id":4626,"date":"2020-05-18T15:21:49","date_gmt":"2020-05-18T19:21:49","guid":{"rendered":"https:\/\/www.theretreatinc.org\/?p=4626"},"modified":"2020-05-18T15:21:49","modified_gmt":"2020-05-18T19:21:49","slug":"rent-law-changes-during-covid-19","status":"publish","type":"post","link":"https:\/\/allagainstabuse.org\/es\/rent-law-changes-during-covid-19\/","title":{"rendered":"Cambios en la ley de alquileres durante el COVID-19"},"content":{"rendered":"<p><em><strong>Por Susan Bereche, Abogada de Retiro<\/strong><\/em><\/p>\n\n\n\n<p>Adem\u00e1s de ampliar la moratoria de los desahucios (y las acciones de ejecuci\u00f3n hipotecaria) hasta el 19 de agosto, las siguientes modificaciones de la ley estatal pueden beneficiar a nuestros clientes:<\/p>\n\n\n\n<p>La Ley de la Propiedad Inmobiliaria se modific\u00f3 para prohibir a los propietarios, arrendadores, subarrendadores y concedentes la imposici\u00f3n y el cobro de recargos por demora y penalizaciones por cualquier alquiler atrasado que fuera o fuera a ser exigible durante el per\u00edodo comprendido entre el 20 de marzo y el 20 de agosto.<\/p>\n\n\n\n<p>La Ley General de Obligaciones fue modificada para permitir a los inquilinos aplicar sus dep\u00f3sitos de seguridad al alquiler mensual; sin embargo, los inquilinos deben tener en cuenta lo siguiente: a) si el dep\u00f3sito de seguridad es inferior al importe del alquiler mensual, los inquilinos siguen estando obligados a pagar la diferencia al propietario; b) dentro de los 90 d\u00edas de aplicar cualquier dep\u00f3sito de seguridad al alquiler mensual, el inquilino debe devolver el importe del dep\u00f3sito aplicado m\u00e1s el 833% del importe del alquiler mensual; c) aunque el inquilino no est\u00e1 obligado a aplicar la fianza si el propietario se lo pide, \u00e9ste debe aceptar la petici\u00f3n del inquilino; y d) el acuerdo de las partes para aplicar la fianza al alquiler mensual debe hacerse por escrito, pero un correo electr\u00f3nico que lo acredite es suficiente para cumplir este requisito.<\/p>\n\n\n\n<p>La disposici\u00f3n que permite la aplicaci\u00f3n de la fianza al alquiler s\u00f3lo est\u00e1 disponible para aquellos que tienen derecho al seguro de desempleo, a las prestaciones federales o estatales o \"que se enfrentan a dificultades financieras debido a la pandemia de COVID-19\".
